These Terms & Conditions ("Terms") govern your use of the Drift & Go mobile application and website (together, the "Service"), operated by DRIFT AND GO TECHNOLOGY - L.L.C ("Drift & Go", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.
1. Acceptance of Terms
By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.
2. Eligibility & Accounts
You must be able to form a legally binding contract to use the Service. You are responsible for the accuracy of the information you provide and for keeping your account credentials secure. You are responsible for all activity that occurs under your account.
3. The Service
Drift & Go lets you browse nearby restaurants, place orders for pickup, track your order status and estimated arrival time, and collect your meal yourself. Drift & Go is a technology platform that connects you with participating restaurants; the restaurants prepare the food and are responsible for its quality, ingredients, and preparation.
4. Orders, Pricing & Payment
- Prices, menu items, and availability are set by the restaurants and may change at any time.
- When you place an order, you authorize payment of the total shown, including any applicable taxes and fees.
- Payments are processed by our third-party payment providers. By placing an order you agree to their processing of your payment.
- An order is confirmed once the restaurant accepts it. We are not responsible for items that are out of stock or for restaurant-initiated changes.
5. Pickup, ETA & Arrival
The Service estimates your arrival time and may notify the restaurant to begin preparing your order as you approach, so your meal is fresh at pickup. Estimated times are provided for convenience and are not guaranteed. You are responsible for collecting your order within a reasonable time. Where applicable, free parking is offered for 15 minutes after scanning the in-app QR code at the restaurant.
6. Cancellations & Refunds
Cancellation and refund eligibility depends on the status of your order and the restaurant's policy. Once a restaurant has begun preparing your order, it may no longer be cancellable. If you experience a problem with an order, contact us via the Contact Us page and we will work with you and the restaurant to resolve it.
7. Restaurant Partners
Restaurants that register with Drift & Go are responsible for setting up their menu, working hours, and pricing, for accepting and managing orders through their dashboard, and for complying with all applicable food-safety, licensing, and consumer-protection laws. Restaurants are independent businesses and are not employees or agents of Drift & Go.
8. Acceptable Use
You agree not to misuse the Service, including by: interfering with its operation or security; attempting to access accounts or data that are not yours; submitting false or fraudulent orders; or using the Service for any unlawful purpose.
9. Intellectual Property
The Service, including its software, branding, logos, and content, is owned by Drift & Go or its licensors and is protected by applicable laws. You may not copy, modify, distribute, or create derivative works without our prior written permission.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted or error-free, or that food quality, preparation, or timing will meet your expectations, as these are the responsibility of the restaurants.
11. Limitation of Liability
To the maximum extent permitted by law, Drift & Go will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from food prepared by restaurants. Our total liability for any claim relating to the Service will not exceed the amount you paid for the order giving rise to the claim.
12. Changes to the Service & Terms
We may modify or discontinue parts of the Service, and we may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law principles. Any disputes will be subject to the exclusive jurisdiction of the competent courts of Dubai, UAE.
